Welcome to Geofencing.pro. Please read these Terms of Service carefully before using our platform. These Terms constitute a legally binding agreement between you and Geofencing.pro (a venture of Big Line Data Systems). By creating an account or using our Services, you agree to these Terms in their entirety.
1. Acceptance of Terms
By accessing or using the Geofencing.pro platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree to these Terms, you are prohibited from using or accessing our Services. These Terms apply to all users of the Services, including advertisers, agencies, and any other parties who access or use the platform. Geofencing.pro is a venture of Big Line Data Systems.
2. Description of Services
Geofencing.pro provides a programmatic advertising platform offering: • Geofencing and location-based advertising campaigns • Mobile Native, Display, Video, OTT/CTV, and Social media advertising • Site retargeting, search retargeting, and advanced audience targeting • Event targeting and trade show audience collection • Conversion zone tracking and campaign performance reporting • Access to our DSP (Demand-Side Platform) network with 2MM+ QPS • White-label programmatic services for advertising agencies Services are provided on a managed-service basis. Campaign performance depends on many factors outside our control, including market conditions, creative quality, and audience availability.
3. Account Registration
To access our Services, you must: • Create an account at dashboard.geofencing.pro • Provide accurate, current, and complete information during registration • Maintain and update your account information to keep it accurate • Be at least 18 years of age or have legal authority to enter into binding contracts • Not share your account credentials with any third party • Notify us immediately of any unauthorized use of your account You are responsible for all activity that occurs under your account. We reserve the right to terminate accounts that violate these Terms or that we determine, in our sole discretion, are being misused.
4. Acceptable Use Policy
You agree not to use our Services to: • Advertise illegal products, services, or activities • Deliver misleading, deceptive, or fraudulent advertising content • Target minors or engage in any practices prohibited under COPPA • Collect personal information from users without appropriate consent • Violate any applicable local, state, national, or international law or regulation • Infringe on intellectual property rights of any third party • Interfere with or disrupt the integrity or performance of our platform • Attempt to gain unauthorized access to our systems or user accounts • Use automated tools to scrape, extract, or abuse platform data • Engage in ad fraud, impression fraud, or click fraud of any kind We reserve the right to immediately suspend or terminate your account for violations of this policy.
5. Campaign Policies & Content Standards
All advertising content submitted through our platform must: • Comply with all applicable advertising laws and regulations (FTC guidelines, etc.) • Accurately represent the advertised products or services • Not contain false or misleading claims • Include appropriate disclosures as required by law • Respect intellectual property rights and obtain necessary licenses for all creative assets • Comply with platform-specific policies for Facebook, Instagram, and other distribution channels • Meet creative specifications provided in our platform documentation We reserve the right to reject, suspend, or remove any campaign that does not meet our content standards without prior notice.
6. Payment Terms
By using our paid services, you agree to: • Pay all fees associated with your campaigns as specified at the time of purchase • Provide valid payment information and authorize us to charge your chosen payment method • Pay for all impressions delivered, as campaign delivery is substantially based on real-time bidding Campaigns require a minimum spend as disclosed during account setup. All fees are non-refundable except as explicitly stated in our Refund & Cancellation Policy. We reserve the right to suspend campaigns for non-payment. Disputed charges must be raised within 30 days of the billing date.
7. Intellectual Property
Geofencing.pro and its content, features, and functionality are owned by Big Line Data Systems and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of all creative assets, data, and content you submit to our platform. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content solely for the purpose of delivering your campaigns. You may not copy, modify, create derivative works of, publicly display, or commercially exploit any portion of our platform without our express written consent.
8. Data & Privacy
Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy. You are responsible for ensuring that any data you provide to us (including CRM data, customer lists, and audience segments) has been collected and shared in compliance with applicable privacy laws, including GDPR and CCPA.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that: • The Services will be uninterrupted, error-free, or completely secure • Campaigns will achieve specific reach, conversion rates, or return on investment • Data or reports will be 100% accurate at all times • The platform will meet your specific requirements Campaign results vary significantly based on industry, creative quality, budget, targeting parameters, and market conditions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GEOFENCING.PRO AND BIG LINE DATA SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
11. Termination
Either party may terminate these Terms at any time: • You may close your account by contacting us at admin@geofencing.pro • We may suspend or terminate your account immediately for violations of these Terms, fraudulent activity, or non-payment • We may terminate or modify the Services at any time with reasonable notice Upon termination, your right to use the Services immediately ceases. Provisions that by their nature should survive termination (including payment obligations, IP rights, disclaimers, and limitations of liability) shall survive.
12. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising from or relating to these Terms or the Services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration. 13. Changes to Terms
